Jury Duty Exemption Age Goes Up to 73 in Virginia

Until now, people who were 70 had the option to be exempt from serving.

By Colleen Kelleher April 16, 2024 at 12:21 pm

If you thought you would no longer have to sit on a Virginia jury once you turned 70, think again. Legislation passed during the 2024 General Assembly session increases the age for jury duty to 73.

People over 70 have had to option to be exempt from jury duty, but that changes on July 1.

The legislation was introduced to increase the number of potential jurors. Some areas of the state have trouble finding enough people to serve of juries.

A bill that passed in the 2022 session allowed defendants to be sentenced by jury rather than a judge, which the jury duty bill’s sponsor Sen. Emily Jordan, R-Isle of Wight, said had increased the number of jury trials.

The age of 73 is the age at which state judges must retire.
